Energy Performance Certificate for sales and rental properties

 Energy Performance Certificate
The energy performance certificate is a document describing energy efficiency of buildings in respect to energy consumption indicating energy efficiency classes by labelling.

Spanish Royal Decree 235/2013 of 5th of April 2013, published in the Spanish Official Gazette BOE on the 13th of April 2013. The certificate should be registered by the building developer or owner at the competent regional authority.

The validity of the certificate shall not exceed 10 years. Cost is dependent on the region where it is registered.

The energy labelling shall be included in every offer, promotion or advertising intended to sell or rent out a property.

The buildings required to have an EPC are any private building unit upon execution of a sale or rental agreement from the 1st of June 2013. Existing buildings or building units occupied by public authorities referred to in Article 2.1.d.

Buildings which are exempt are

a) Officially protected buildings.
b) Buildings used as places of worship and for religious activities.
c) Temporary buildings with a planned time of use of two years or less.
d) Industrial buildings intent to be used as workshops.
e) Stand-alone buildings with a total useful floor area of less than 50 m2.
f) Buildings which may be bought to undergo major renovation works or to be demolished.
g) Existing residential buildings or building units which are intended to be used less than four months of the year or for a limited period in the year and their foreseen energy consumption is lower than 25% if they were to be used during a whole year.

The certificate must be issued by architects and engineers with an intermediate or higher university degree.
Experts exclusively qualified to issue energy performance certificates.

The EPC will be required by Notarios prior to signing the new escritura (Title Deed).
